PRIVACY POLICY

LIABILITY WAIVER

PARTICIPATION AGREEMENT, HEALTH & SAFETY POLICY, WAIVER, RELEASE OF LIABILITY, MEDIA AUTHORIZATION & POLICIES

THIS IS A RELEASE OF LIABILITY. PLEASE READ CAREFULLY BEFORE SIGNING.

1. PARTIES COVERED BY THIS AGREEMENT

This Agreement applies to all programs, services, facilities, and activities conducted by the released parties. For purposes of this Agreement, “Released Parties” shall include: Elevate Three Basketball Training LLC (E3BT), Elevate Three Sports Performance LLC, (E3SP), Elevate Three Egaming LLC, (E3EG), Elevate Three Podcast Studios LLC, (E3PS), ElevateOne Health & Wellness Services LLC, ChikambaOne Media Group LLC, Skill Lab LLC, Indy Holdings (property owner/landlord), The City of Indianapolis, and each of their respective owners, members, managers, officers, directors, employees, contractors, coaches, trainers, volunteers, agents, representatives, insurers, affiliates, subsidiaries, successors. It assigns collectively to the “Released Parties.”

By signing & participating in the activities at Elevate Three Basketball Training,  I acknowledge and agree as follows:

1. HEALTH & SAFETY POLICY

At Elevate Three Basketball Training, athlete health and safety are our top priority. Our policy mandates that anytime an athlete reports or exhibits symptoms such as:

  • Pain
  • Headaches
  • Nausea
  • Difficulty breathing
  • Lightheadedness
  • Blurred vision
  • Stomach pain
  • Any other physical discomfort

They will be immediately removed from activity.

The athlete will be required to sit out, and a parent or guardian will be notified promptly for further consultation and direction.

Participation will not resume until the athlete is cleared by a parent/guardian and, when appropriate, a medical professional.

We follow a strict “When in doubt, sit them out” approach to protect the well-being of every athlete.

For additional safety and security, our facility is equipped with CCTV monitoring to help provide a safe and supervised training environment at all times.

Our commitment is to create a positive, secure, and athlete-centered space where players can develop with confidence.

2. ASSUMPTION OF RISK

I understand that participation in basketball training and performance activities involves inherent risks, including but not limited to:

  • Physical injury
  • Emotional, psychological, or spiritual distress
  • IllnessPermanent disability
  • Death

I acknowledge that these risks may arise from participation in training sessions, camps, clinics, the use of equipment, or the presence on the premises.

I voluntarily assume all risks, known or unknown, foreseeable or unforeseeable.

I affirm that I do not have any medical condition that would increase the likelihood of injury.

3. RELEASE OF LIABILITY

In consideration of being permitted to participate:

I release, waive, discharge, and agree not to sue Elevate Three Basketball Training LLC, Skill Lab LLC, ChikambaONE Media Group LLC, Indy Holdings (landlord), Elevate Three Sports Performance LLC, (E3SP), Elevate Three Egaming LLC, (E3EG), Elevate Three Creative Studios LLC, (E3CS), ElevateOne Health & Wellness Services LLC,  The City of Indianapolis and their owners, employees, representatives, agents, contractors, and affiliates from any liability relating to injuries, damages, or losses.

This release applies EVEN IF ARISING FROM THE NEGLIGENCE of the Released Parties, to the fullest extent permitted by Indiana law.

I forfeit all rights to bring suit for any reason arising from participation in training or presence at the facility.

4. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from any claims, liabilities, damages, losses, settlements, expenses, court costs, and attorneys’ fees arising from my participation or my minor child’s participation.

5. PROPERTY DAMAGE RESPONSIBILITY

I agree to reimburse the Released Parties for any damage caused by my minor child or me to property, facilities, or equipment, whether intentional or unintentional, at full repair or replacement cost deemed appropriate by ownership or staff.

6. CONDUCT & RIGHT OF REMOVAL

The Released Parties reserve the right to refuse or terminate participation if the behavior:

  • Endangers others
  • Damages property
  • Disrupts training
  • Violates facility policies

No refunds will be issued in such circumstances.

7. FACILITY RULES

To ensure safety and professionalism:

  • No food, gum, or non-water drinks near the court.
  • No outside shoes allowed on the court.
  • Basketball sneakers must be worn and must not be worn outside the facility.
  • All payments and waivers must be submitted before participation.
  • Equipment may NEVER be used unsupervised (including Vertimax, Elevate Three Sports Performance, dribble ramp, weights, and other tools).
  • Athletes must leave the court promptly at the end of their session unless if they are cleared to use the premises by our staff
  • Parents/guardians must refrain from coaching or commenting during sessions.
  • Any injuries or special considerations must be disclosed during the FIRST session.

Failure to comply may result in expulsion without refund.

8. TRAINING POLICIES & GUARANTEE

We do NOT guarantee:

  • That athletes will make it on any school teams, rec or travel that they try out for
  • A specific duration beyond the scheduled time

  • A permanent training schedule

Schedules may change.

Training

  • Sessions last 60 minutes
  • 6–7 similarly skilled athletes for certain classes
  • 10 – 12 for group classes
  • Packages expire 90 days from purchase
  • Sessions require a 24-hour cancellation notice
  • Late arrivals do not extend session time
  • More than 15 minutes late = forfeited session
  • Packages cannot be shared

  • Missed sessions do not roll over

9. CANCELLATION, REFUND & MAKE-UP POLICY

Memberships:

  • May be canceled anytime via the website link
  • Are non-refundable
  • Must be canceled before the next billing date

  • Failure to cancel results in a charge

Prepaid team training:

  • 100% refund on remaining sessions with 48-hour written notice

Clinics & Camps:

  • 48-hour notice required for refund
  • Credits may be issued (processing fee applies). Credits not valid for small group/personal training

Retail:

  • No refunds

  • Unworn items may be exchanged

Make-Ups:

  • One make-up per 30-day billing cycle

  • Do not roll over

Health Protocol:

  • Do not attend if fever within last 24 hours

  • Notify our staff of any health concerns

10. MEDIA & IMAGE RELEASE

I grant permission to Elevate Three Basketball Training to use my likeness or my child’s likeness in photographs, videos, recordings, website content, social media, marketing materials, and other lawful uses.

I understand:

  • No compensation will be provided
  • Media becomes property of Elevate Three Basketball Training
  • I waive the right to inspect or approve
  • I waive claims, including defamation, invasion of privacy, or publicity rights

This authorization applies to all future visits.

I also grant permission to use my email for newsletters and promotional communications (with unsubscribe option).

11. PRIVACY POLICY

We collect:

  • Name(s)
  • Contact information
  • Age, grade,
  • Other relevant training information, (skill level)

We use this information for:

  • Internal record keeping
  • Service improvement
  • Training customization

  • Promotional communication

We DO NOT sell personal information.

Transactions are processed securely through third-party payment processors.

We maintain physical, electronic, and procedural safeguards to protect personal data in compliance with applicable law.

12. PARENT / GUARDIAN CONSENT (FOR MINORS)

If signing for a minor under 18:

I certify that I am the legal guardian and consent to participation.

I release, indemnify, and hold harmless the Released Parties from all liability, INCLUDING NEGLIGENCE, to the fullest extent permitted by law.

ACKNOWLEDGMENT

I HAVE READ THIS AGREEMENT CAREFULLY.
I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS.
I SIGN THIS AGREEMENT VOLUNTARILY.
